Tile Redi USA, LLC - Limited Warranty
To assure our customers of the high quality of the Tile RediTM shower pan (“Shower Pan”), Redi Wall® shower wall panels (“Panels”), and Redi SealantTM (“Sealant”) (each, a “Product”), Tile Redi USA, LLC (“Tile Redi”) offers the following limited warranties for installation at a property (“Property”):
Standard Warranty: Subject to the limitations set forth below, Tile Redi warrants to the original owner of the Property at the time of an individual Product’s installation (“Original Property Owner”) that purchases the Product from Tile Redi or an authorized retailer in the United States or Canada, that the Product is free from defects in material or workmanship under normal use and service for ten (10) years from the date of original installation.
25–Year Warranty: Subject to the limitations set forth below, for installations that include a Shower Pan, Panel(s), and Sealant installed together by a Pro Installer (“Complete Tile Redi System”), Tile Redi warrants to the Original Property Owner that purchases such Shower Pan, Panel(s), and Sealant used in the Complete Tile Redi System from Tile Redi or an authorized retailer in the United States or Canada, that the Products used in the Complete Tile Redi System are free from defects in material or workmanship under normal use and service for twenty five (25) years from the date of original installation.
Exceptions to the Warranties: Tile Redi shall be excused from the remedy obligations under these limited warranties to the extent that any nonconformance or defect in the Product arises from any cause other than breach of the warranties above, including, without limitation: (i) if the Product has been moved from its initial place of installation; (ii) if the Product has been subjected to faulty maintenance, abuse, misuse, accident, contamination, theft, negligence, other damage or acts or omissions of a third party; (iii) if the Product was not installed in accordance with Tile Redi’s instructions (including documentation provided with the Product); (iv) if the Product was modified or altered in a manner inconsistent with the Product as shipped by Tile Redi; (v) if any tile, marble or other material is removed from the shower pan module after the original installation; (vi) normal wear and tear; and/or (vii) if the Product was not installed using all of the required system components (i.e., Shower Pan, Panels, and Sealant) for the 25-Year Warranty. The Original Property Owner shall at its own expense apply for and obtain any permits and inspections required for the installation and/or use of the Tile Redi Products. Only Tile Redi approved setting materials – including the Sealant for applicable installations – shall be used with an applicable Product. Failure to use such approved setting materials shall void these limited warranties and may disqualify eligibility for 25-Year Warranty coverage.
Exclusive Remedy: THE WARRANTIES SET FORTH ABOVE – INCLUDING THE STANDARD WARRANTY AND THE 25-YEAR WARRANTY – ARE TILE REDI’S SOLE AND EXCLUSIVE WARRANTIES WITH RESPECT TO ITS PRODUCTS AND TILE REDI HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
If a Tile Redi Product fails to conform to the above warranties after inspection by an authorized Tile Redi representative, the obligation of Tile Redi shall be limited to repairing or replacing such defective workmanship or material, at its option. THE FOREGOING REMEDY OBLIGATION SHALL BE TILE REDI’S SOLE AND EXCLUSIVE LIABILITY FOR ANY DEFECTIVE OR NONCONFORMING PRODUCT OR BREACH OF THE WARRANTIES SET FORTH ABOVE.
IN NO EVENT SHALL TILE REDI HAVE ANY LIABILITY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, LIQUIDATED OR CONSEQUENTIAL DAMAGES UNDER THESE LIMITED WARRANTIES, ALL OF WHICH ARE EXPRESSLY EXCLUDED AND DISCLAIMED HEREBY. WHERE, DUE TO OPERATION OF LAW, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, LIQUIDATED, OR CONSEQUENTIAL DAMAGES UNDER THESE WARRANTIES, OR UNDER ANY IMPLIED WARRANTY CANNOT BE EXCLUDED, THEY ARE EXPRESSLY LIMITED IN AMOUNT TO THE PURCHASE PRICE OF THE PRODUCT. All stated warranty terms are conditional upon the product being installed according to Tile Redi’s guidelines and in compliance with applicable warranty tier criteria.
Warranty Claims:
To submit a warranty claim or to ask questions about a Product or its warranty, please contact info@tileredi.com | follow the steps found at tileredi.com/pages/technical-information-limited-warranty. Upon approval of a warranty claim, Tile Redi will repair or replace such defective workmanship or material, at its option, without charge. If the warranted Product is no longer available, a replacement Product of equal or greater retail value may be substituted. These warranty claims are limited to purchases within the United States and Canada and can only be claimed through Tile Redi.
In the event of a limited warranty claim by the Original Property Owner, proof of purchase and/or a sales receipt will be required. Tile Redi’s remedy obligation under these limited warranties does not cover any labor or other costs of removal or installation. Tile Redi shall not be liable for damages to or replacement of substrate to which the Product has been attached or for the cost of repair or replacement of any installation materials, including but not limited to, tiles, marble or any such other similar materials.
